True, but it has to be contextualized by products. You can't simply trademark "TM" in and of itself.

"TM" Brand T-shirts, on the other hand, have much potential...

Right you are. Now I can claim the rights to at least some domains of TM through my distinctively self-referential brand of IronyWear (http://www.cafeshops.com/learnedax). This amuses me in a Weeping Gorilla kind of way.
