Great. My insurance company is billing me the $1K deductible on the grounds that being hit while making a three-point turn makes me automatically at fault. If I can successfully contest the decision through a painful hearing process, they will probably reimburse it, sometime in the future.

For now, [livejournal.com profile] cristovau, looks like you're fully covered.

Update: I was wrong, the insurance will pay back any additional cost in higher premia that I may have paid before the hearing. They have a standard policy of never refunding the deductible.

Figures... there was maybe $100 damage to my car and I never contested to being at fault! In fact, I even said I thought I was at fault over the phone.

Gotta wonder if this isn't some sort of jerk around. The lowest bill is obviously the victim. My bank account has been skirting minimal for a while now, but I could chip in to the help fix the car fund on March 4th. Even if I'm not technically at fault, I did hit you and I think your insurance company is being stupid.

i think they are beign extra stupid, especially in light of what you jsut said, since they claim you specifically contested and said you were not at fault. ugh.

As I said to Alex otherways, this doesn't look like stupidity, it looks like willful collusion to screw the two of you out of the most money.

Ask for a paper trail backing up this claim. Sounds like at least one of the companies involved is lying in order to extract more money, possibly both. Since this probably works on most people, it isn't exactly stupid but it is venal, wrong, and probably illegal.

As far as I could tell from my accident, if the other driver specifically says that s/he is at fault, then the investigation should be short (emphasis on should) and you shouldn't have to pay your deductible.

However, my insurance company tried to jerk me around about towing fees and such, so I ended up talking directly to the other person's insurance company about the car damage. They were the ones that paid for everything directly - I would have thought that it would be better to subrogate to my insurance company and have them fight for me, but I was wrong (at least in my case).

being hit while making a three-point turn makes me automatically at fault.

When you see the phrase "automatically at fault", fight that bastard! At least, if you don't believe that you *were* at fault. That kind of bullshit policy is just there to make life easier for the insurer, so they can make snap judgements without thinking. Don't let them!

I, personally, would also not give them a cent of allegedly non-refundable-even-if-we-later-admit-we-were-wrong money.

Damn, this shit makes me mad! Probably just as well I gave up the whole car-ownership thing. (Which, by the way, was directly prompted by insane insurance costs.)

SOMEbody has to pay the deductible to the repairman so you can get your car back. I think it ought to be Chris's insurance company.
